WHAT ARE COOKIES?

Like the vast majority of other websites, we use ‘cookies’ in order to provide you with the best possible experience when you visit it. Cookies are small text files that are stored on your computer when you visit a web page. They can have many purposes, and among other things may be used to store your preferences, keep you logged into a website, or to collect visitor statistics – e.g. finding out how many users viewed the site and the pages they accessed.

Cookies may be stored by the website you are visiting, or by third parties who provide content that is embedded upon the site – such as YouTube videos. Some cookies are deleted automatically when you close your browser, others remain for longer periods – e.g. to retain any website preferences you have set on previous occasions.

By visiting the Timepieces website you consent to cookies being stored on your computer or device. If you wish, you can disable cookies via your browser settings, however some website functionality may not work as expected.

WHAT COOKIES ARE USED ON THE SWISS DREAMS WEBSITE?

Below are more details about the cookies that are stored when you visit the Timepieces site. These are broken down into the 4 separate categories proposed by the International Chamber of Commerce (ICC).

These cookies are essential in order to enable you to move around the website and use its features, such as accessing secure areas of the website. Without these cookies services you have asked for, like shopping baskets or e-billing, cannot be provided.

These cookies are used to keep track of the current user’s session – for example to detect whether a visitor is supposed to be logged in, and for the purposes of keeping track of what items are currently in your basket during an online purchase. The website will not function correctly if these cookies are not stored.

 Performance Cookies

These cookies collect information about how visitors use a website, for instance which pages visitors go to most often, and if they get error messages from web pages. These cookies don’t collect information that identifies a visitor. All information these cookies collect is aggregated and therefore anonymous. It is only used to improve how a website works.

FUNCTIONALITY COOKIES

These cookies allow the website to remember choices you make (such as your user name, language or the region you are in) and provide enhanced, more personal features. For instance, a website may be able to provide you with local weather reports or traffic news by storing in a cookie the region in which you are currently located. These cookies can also be used to remember changes you have made to text size, fonts and other parts of web pages that you can customise. They may also be used to provide services you have asked for such as watching a video or commenting on a blog.

Targeting or Advertising Cookies

These cookies are used to deliver adverts more relevant to you and your interests. They are also used to limit the number of times you see an advertisement as well as help measure the effectiveness of the advertising campaign. They are usually placed by advertising networks with the website operator’s permission. They remember that you have visited a website and this information is shared with other organisations such as advertisers.

No ‘targeting or advertising’ cookies will be stored by us when a user visits this website.

HOW CAN I PREVENT COOKIES FROM BEING STORED?

If you wish, you can set up your web browser (e.g. Internet Explorer, Mozilla Firefox, Google Chrome etc) to prevent cookies from being stored when you visit a website. Depending on the browser you are using, you can choose just to prevent specific websites from setting cookies (e.g. Timepieces), or alternatively prevent all websites from storing cookies. You may also be able to control the types of cookies that can be stored, and delete any existing cookies that have been stored already. Please be aware that if you choose to do this, some functionality on this website may not work as expected.

Arbitration and Class Action Waiver Agreement:

Arbitration:

By using or purchasing Swiss Dream’s products or services, you agree that any controversy, claim, action, or dispute between you and Swiss Dream’s arising out of or relating to: (a) these Terms, or the breach thereof; or (b) your access to or use off Swiss Dream’s website or the services or the materials; or (c) any alleged violation of any federal or state or local law, statute or ordinance (each such controversy or claim, a “Claim”), shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association in accordance with its applicable rules.

Arbitration is a form of dispute resolution in which parties agree to submit their disputes and potential disputes to a neutral third person (called an arbitrator) for a binding decision, instead of having such dispute(s) decided in a lawsuit, in court, by a judge or jury trial. The arbitrator is obligated to issue a reasoned award in writing, including all findings of fact and law upon which the award was made. The arbitrator shall not have the power to commit errors of law, and the arbitrator’s award may be vacated or corrected through judicial review by a court of competent jurisdiction. Each party’s attorneys’ fees, expert costs, and other costs and expenses incurred in connection with arbitration will be borne by the party incurring such costs and expenses.

Arbitration Procedures:

Claims shall be heard by a single arbitrator. Arbitrations shall be held in Broward County, Florida, USA but the parties may choose whether to appear in person, by phone, or through the submission of documents.  The arbitration shall be governed by the Federal Arbitration Act (“FAA”) and by the internal laws of the Florida, without regard to conflicts of laws principles. Any disputes in this regard shall be resolved exclusively by an arbitrator. If, but only if, the arbitrator determines the FAA does not apply, Florida law governing arbitration agreements will apply. All disputes with respect to whether the foregoing mutual arbitration provisions are unenforceable, unconscionable, applicable, valid, void or voidable shall be determined exclusively by an arbitrator, and not by any court.

Exclusion from Arbitration:

Notwithstanding the terms of this Arbitration Agreement, you may choose to pursue a Claim in court and not by arbitration if you opt-out of these arbitration procedures within 30 days from the date that you first purchase any of Swiss Dream’s products or services (the “Opt-Out Deadline”). You may opt out by mailing a written notification to 18459 Pines Blvd, STE 213, Pembroke Pines Florida 33029. Your written notification must include (1) your name, (2) your address, and (3) a clear statement that you do not wish to resolve disputes through arbitration. Your decision to opt-out will have no adverse effect on your relationship with [Brand]. You are responsible for ensuring Swiss Dream’s receipt of your opt-out notice, and you therefore may wish to send a notice by means that provide a written receipt.  Any opt-out request received after the Opt-Out Deadline will not be valid and you must pursue your Claim in arbitration.

Class Action Waiver:

You and Swiss Dreams agree that you may bring or participate in Claims against Swiss Dreams only in your respective individual capacity, and not as a plaintiff or class member in any purported class, consolidated, or representative proceeding.  Unless both you and Swiss Dreams agree otherwise in writing, the arbitrator may not consolidate or join the claims of other persons or parties who may be similarly situated and may not otherwise preside over any form of a representative or class proceeding. Notwithstanding any other clause contained in this Agreement, any Claim that all or part of this Class Action Waiver is unenforceable, unconscionable, void or voidable may be determined only by a court of competent jurisdiction and not by an arbitrator.

OPT OUT.
